Cut Panel Calculator Terms of Service

Your use of the Cut Panel Calculator service (“Tynic Cut Panel Calculator”), including any Tynic Automation applications downloaded through the Microsoft store (“Window Apps”), is governed by the following terms and conditions (“Cut Panel Calculator Terms of Service”).

Specific Terms for Tynic Users

Children under the age of 14, or equivalent minimum age in the relevant jurisdiction, are not permitted to use Tynic Cut Panel Calculator. If you are 14 or the equivalent minimum age in the relevant jurisdiction or older, but under the age of 18, you should review this Agreement with your parent or guardian to make sure that you and your parent or guardian understand and agree to the following terms.

Indemnity

You agree to indemnify and hold Tynic Automation Pty Ltd, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Tynic Automation Pty Ltd by any third party due to or arising out of or in connection with your use of the Application.

TYNIC DOES NOT PROMISE THAT THE APPLICATION OR ANY CONTENT, SERVICE OR FEATURE OF THE APPLICATION WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE APPLICATION WILL PROVIDE SPECIFIC RESULTS. THE APPLICATION AND ITS CONTENT ARE DELIVERED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. ALL INFORMATION PROVIDED ON THE APPLICATION IS SUBJECT TO CHANGE WITHOUT NOTICE. TYNIC CANNOT ENSURE THAT ANY FILES OR OTHER DATA YOU DOWNLOAD FROM THE APPLICATION WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. TYNIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TYNIC DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO YOUR USE OF THE SITE AND/OR ANY TYNIC SERVICES. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE APPLICATION AND ANY LINKED SITES. YOUR SOLE REMEDY AGAINST TYNIC FOR DISSATISFACTION WITH THE APPLICATION OR ANY CONTENT IS TO STOP USING THE SITE OR ANY SUCH CONTENT. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES.

Changes to Terms and Conditions

Tynic Automation Pty Ltd may revise and update these Terms and Conditions at any time. Your continued use of the Application will constitute your acceptance of these changes.

Termination

We reserve the right to terminate your account or access to our services at our discretion, without prior notice, if you violate these Terms and Conditions, engage in any fraudulent, unlawful, or harmful activity, or for any other reason that we deem necessary to protect the integrity of our services.

In the event of account termination, we will make reasonable efforts to notify you via the email address associated with your account. You are responsible for keeping this contact information up to date.

Upon account termination, you may lose access to any data or content you have stored on our platform. We are not responsible for maintaining or providing access to this data.

Termination of your account will result in the revocation of your access to our services. All provisions of these Terms and Conditions, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If you believe your account was terminated in error, you may submit an appeal to our support team. We will review your appeal and may, at our sole discretion, reinstate your account.

Severability

If any part of these Terms and Conditions is found to be unenforceable, invalid, or unlawful, the remaining provisions will continue to be in full force and effect. The unenforceable, invalid, or unlawful part will be considered superseded by a valid, enforceable provision that most closely matches the original intent of the original provision. This determination will not affect the validity and enforceability of any other remaining provisions.
